அநீதிக்கு மேல் அநீதி.. அநீதியைத் தட்டிக் கேட்க ஜனவரி 27ல் ஆர்த்தெழுவோம்!




பாபர் மஸ்ஜித் இடிக்கப்பட்டது முதல் அதை முஸ்லிம்களிடம் ஒப்படைக்க வலியுறுத்தியும் பாபர் மஸ்ஜிதை இடித்த பாவிகளை சட்டத் தின்படி தண்டிக்க வலியுறுத்தியும் நாம் உள்பட பல்வேறு இயக்கங்கள் டிசம்பர் ஆறாம் நாளில் போராட்டங்களை விடாமல் நடத்தி வந்தோம். நீதிமன்றம் விரைந்து தீர்ப்பளிக்கக் கோரி நாம் நடத்திய அனைத்து போராட்டங்களையும் அலகாபாத் உயர் நீதிமன்றம் அர்த்தமற்றதாக்கி விட்டது.
சொத்துரிமைக்கும், மத உரிமைக்கும் விரோதமாக அமைந்த தீர்ப்பு உலக மக்களுக்கு அதிர்ச்சியையும் ஏமாற்றத்தையும் ஏற்படுத்தியது. பாபர் மஸ்ஜிதை இடித்த குற்றமும் நியாயப் படுத்தப்பட்டு விட்டது. ஆரம்பம் முதலே அங்கே கோவில்தான் இருந்தது என்ற தவறான தீர்ப்பின் மூலம் பாபர் பள்ளிவாசலை யாரும் இடிக்கவில்லை என்ற தவறான நிலையை ஏற்படுத்தி விட்டது.
நீதிமன்றங்கள் மீது நாம் வைத்த அசைக்க முடியாத நம்பிக்கை கேள்விக்குறியாகி விட்டது. எனவே இனி நீதிமன்றங்களின் தவறுகளை சுட்டிக்காட்டுவதன் மூலம்தான் எதிர் காலத்தில் முஸ்லிம்களின் உரிமையைக் காப்பாற்ற முடியும் என்ற நிலைக்கு முஸ்லிம்கள் தள்ளப்பட்டு விட்டனர். நீதிமன்றத் தீர்ப்புகள் விமர்சனத்திற்கு உட்பட்டவை என உச்ச நீதிமன்றம் ஏற்கெனவே தீர்ப்பளித்துள்ளது. டிசம்பர் 6 அன்று போராட்டம் நடத்துவதை விட இன்ஷா அல்லாஹ் ஜனவரி 4ம் தேதியன்று சென்னையிலும் மதுரையிலும் இலட்சக்கணக்கான முஸ்லிம்கள் அந்தத் தீர்ப்பை ஆட்சேபணை செய்யும் வகையில் ஆர்ப்பரித்து எழ தவ்ஹீத் ஜமாஅத் அனைத்து முஸ்லிம்களையும் அழைக்கிறது.
வெள்ளையன் ஆட்சியில்
பாபர் மஸ்ஜித் பிரச்சினையில் ஆள்வோரும் அதிகார வர்க்கமும் முஸ்லிம்களுக்குத் தொடர்ந்து துரோகம் செய்து வந்ததை முஸ்லிம் சமுதாயம் தெளிவாகப் புரிந்துவைத்துள்ளது.
ஆனால் அரசியல்வாதிகளையும், அதிகார வர்க்கத்தையும் மிஞ்சும் வகையில் நீதிமன்றங்களும் தவறு இழைக்கும் என முஸ்லிம் சமுதாயம் அறிந்து கொள்ளவில்லை.
நீதிமன்றங்களின் தீர்ப்புகளை விமர்சிக்கக் கூடாது என்ற அறியாமை காரணமாகவும்,  நீதி மன்றத்தின் தீர்ப்பை முஸ்லிம்கள் ஏற்றுக் கொள்வோம் என்று சில முஸ்லிம் இயக்கங்கள் பிரச்சாரம் செய்ததன் காரணமாகவும் நீதி மன்றங்களின் நியாயங்கள் முஸ்லிம் சமுதாயத்துக்குச் சென்றடையவே இல்லை.
நீதிமன்றங்கள் இப்போதுதான் முதன் முதலில் தவறாகத் தீர்ப்பளித்து விட்டது போலவும், அதற்கு முன்பு நீதிமன்றங்கள் சட்டத்திற்கு உட்பட்டு நேர்மையான முறையில் நடந்து கொண்டது போலவும் என்ற மாயத் தோற்றம் ஏற்படுத்தப்பட்டுள்ளது.
ஆனால் உண்மை என்ன? பாபர் மஸ்ஜித் தொடர்பான வழக்குகள் அனைத்திலும் ஒவ்வொரு கட்டத்திலும் நீதிமன்றங்கள் மத உரிமை, உணர்வு ஆகியவைகளுக்கு விரோத மாகத்தான் தீர்ப்பு வழங்கி வந்துள்ளன.
நீதிமன்றங்கள் எத்தகைய தவறான தீர்ப்புகளை வழங்கினாலும் ஏமாந்த முஸ்லிம் சமுதாயம் அதைக் கண்டு கொள்ளாது என்று நீதி மன்றங்கள் வைத்துள்ள அசைக்க முடியாத நம்பிக்கையே இந்த விபரீதங்களுக்கு காரணமாக அமைந்துள்ளது.
நீதிமன்றங்கள் உள்ளிட்ட அனைத்து அமைப்புகளும் விமர்சனத்துக்கு உட்பட்டவை தான்; அவை அநீதி இழைக்குமானால் அவை கண்டனத்திற்குரியவைதான் என்று தெள்ளத் தெளிவாக உணர்த்தினால்தான் எதிர் காலத்தில் மதவெறி பிடித்து சட்டத்தை மீறும் நீதித்துறைக்கு எச்சரிக்கையாக அமையும்.
இதற்காகத்தான் ஜனவரி 4ம் தேதியன்று நீதிமன்றத்தின் நியாயமற்ற தீர்ப்புக்கு எதிராக ஒட்டு மொத்த முஸ்லிம் சமுதாயத்தின் கடும் கண்டனத்தைப் பதிவு செய்ய உங்களை அழைக்கிறோம்.
உரிமை காத்த வெள்ளையர்கள்!
பாபர் மஸ்ஜித் குறித்து நாடு சுதந்திரம் அடைவதற்கு முன் வெள்ளையர் ஆட்சியி லும் வழக்குகள் தொடரப்பட்டன. முதல் வழக்கு
மகந்த் ரகுபர் தாஸ் என்பவர் 61/280/1885 என்ற வழக்கு தொடுத்தார். பாபர் மஸ்ஜிதுக்கு அல்லது அதைச் சுற்றியுள்ள சொத்துகளுக்கு உரிமை கோரி அந்த வழக்கு தொடரப்பட வில்லை. பாபர் மஸ்ஜித்துக்குச் சொந்தமான காலி இடத்தில் ராமர் பாதம் உள்ளது. அந்த இடத்தில் பக்தர்கள் வெயிலிலும், மழையிலும் நின்று கஷ்டப்படுகிறார்கள். எனவே அந்த இடத்தில் மேற்கூரை அமைக்க அனுமதிக்க வேண்டும் என்பதுதான் அந்த வழக்கு.
அந்த வழக்கில் கோரப்பட்ட இடம் 21 X 17 = 357 சதுர அடி. பாபர் மஸ்ஜிதைச் சுற்றியுள்ள 67 ஏக்கர் நிலத்தில் வழக்குத் தொடுத்தவர் சொந்தம் கொண்டாடியது 357 சதுர அடிதான். ஒரு செண்டுக்கும் குறைவான இடத்தின் மீது கட்டடம் கட்டத்தான் அனுமதி கேட்டு வழக்கு போடப்பட்டது.
அப்போது பைஸாபாத் நீதிபதியாக இருந்த பண்டிட் ஹரி கிருஷ்ணன் இந்த வழக்கில் பிப். 27, 1885ல் தீர்ப்பு அளித்தார்.
அந்த இடம் (357 சதுர அடி) வழக்குத் தொடுத்தவருக்குச் சொந்தமானது என்றாலும் அங்கே பள்ளிவாசல் இருந்து வருவதால் கோவில் கட்ட அனுமதிக்க முடியாது. சட்டம் ஒழுங்குப் பிரச்சினை ஏற்படும் என்பது அவரது தீர்ப்பு. மேல் முறையீடு
இந்தத் தீர்ப்பை எதிர்த்து மகந்த் ரகுபர் தாஸ் மேல் முறையீடு செய்தார். அப்போது பைஸாபாத் மாவட்ட நீதிபதியாக எஃப்.இ.ஏ. சேமியர் இருந்தார். இவர் சம்பந்தப்பட்ட இடத்தை நேரடியாக ஆய்வு செய்து விட்டு 1886 மார்ச் 18ல் தீர்ப்பளித்தார்.
அந்த இடம் ரகுபர் தாசுக்குச் சொந்தமானது அல்ல என்று தீர்ப்பளித்ததுடன் 357 சதுர அடியில் கோவில் எழுப்பவும் தடை விதித்தார்.
இரண்டாம் மேல் முறையீடு
இந்தத் தீர்ப்பையும் எதிர்த்து மகந்த் ரகுபர் தாஸ் மேல் முறையீடு செய்தார். நீதிபதி டபிள்யூ. யங்க் முன்னிலையில் வழக்கு விசாரணைக்கு வந்தது. இந்த வழக்கை விசாரித்த நீதிபதி ஆவணங்களின்படியும், சட்டப்படியும் அந்த 357 சதுர அடி நிலம் தனக்குச் சொந்த மானது என்பதற்கு மகந்த் ரகுபர் தாஸ் தக்க ஆதாரம் எதையும் காட்டவில்லை எனக் கூறி அந்த வழக்கை 1886 நவம்பர் 1ல் தள்ளுபடி செய்தார்.
வெள்ளையர்கள் ஆட்சியில் வெறும் 357 சதுர அடி நிலத்திற்குக் கூட இந்துக்களுக்குச் சட்டப்படி உரிமை இல்லை என்று தெளிவாகத் தீர்ப்பு அளிக்கப்பட்டு முழு இடமும் முஸ்லிம்களுக்கே சொந்தமானது என்று சட்டப்படி தீர்ப்பளிக்கப்பட்டு விட்டது.
சுதந்திர இந்தியாவில் காவி நீதிமான்கள்!
ஆனால் நாடு விடுதலை அடைந்த பின்னர் நாட்டு விடுதலைக்கு அதிகமதிகம் பாடுபட்ட மக்களுக்கு ஆள்வோரை மிஞ்சும் வகையில் நீதிமன்றங்கள் தொடர்ந்து அநீதியை இழைத்து வந்தன. அந்த வரலாறுகளையும், முஸ்லிம்கள் அறிந்து கொள்வது அவசியமாகும்.
நீதிமன்ற அநீதி – 01
1949 டிசம்பர் 22ம் தேதி இரவோடு இரவாக பாபர் பள்ளியில் ராமர், சீதை, லட்சுமணன் சிலைகளைக் கொண்டு போய் வைத்த சமூக விரோதிகள் பிரச்சினையை ஆரம்பித்து வைத்தனர்.
ஒரு விநாடியில் அதைத் தூக்கி வெளியே போடுவது தான் சட்டப்படி செய்ய வேண்டிய காரியம் என்ற போதும் நீதிபதி அந்தஸ்தில் உள்ள கே.கே நய்யார் அதை அப்புறப்படுத்த மறுத்து உத்தரவிட்டார். நீதியின் பெயரால் நடந்த முதல் அநீதி இது. இந்த நீதிபதி பின்னாளில் ஜனசங்கம் என்ற சங்பரிவார இயக்கத் தில் சேர்ந்தார்.
நீதிமன்ற அநீதி – 02
சிலைகளை அப்புறப்படுத்தக் கோரியும், அந்த இடத்தை முஸ்லிம்கள் வசம் ஒப்படைக்கக் கோரியும் முஸ்லிம்கள் வழக்குத் தொடுத்தனர். ஆனால் அதை ஏற்க மறுத்த நீதிமன்றம் சிலைகளைக் காப்பாற்ற ரிஸீவரை நியமித்து தன் பொறுப்பில் எடுத்துக் கொண்டது. இது இரண்டாவது அநீதியாகும்.
நீதிமன்ற அநீதி – 3
1950 ஜனவரி 16 அன்று சிலைகளை அகற்றக் கூடாது என்று கோரி கோபால் சிங் விஷாரத் பைஸாபாத் உரிமையியல் நீதிமன்றத்தில் வழக்குத் தொடர்ந்தார். அவரது கோரிக்கையை ஏற்று சிலைகளை அகற்றக் கூடாது என்று இடைக்கால உறுத்துக் கட்டளை உத்தரவு பிறக்கப்பட்டு மூன்றாவது அநீதி அரங்கேற்றப்பட்டது.
நீதிமன்ற அநீதி – 04
மகந்த் பரமஹம்ஸ ராமச்சந்திர தாஸ் என்பவர் பள்ளிவாசலுக்குள் வைக்கப்பட்ட சிலைகளுக்குப் பூஜை செய்ய அனுமதி கேட்டு வழக்குத் தொடுக்கிறார். 1950 டிசம்பர் 5ல் இதற்கு அனுமதிக்கப்படுகிறது. அதாவது சட்ட விரோதமாக பள்ளிவாசலுக்குள் சிலையை வைத்து விட்டு அந்தச் சிலைகளுக்கு பூஜை செய்ய அனுமதித்ததற்கு மதவெறி தவிர வேறு சட்டக் காரணம் ஏதுமில்லை. இது காவி நீதிமான்கள் செய்த நான்காவது அநீதியாகும்.
நீதிமன்ற அநீதி – 05
இந்த வழக்கில் நிர்மோகி அகாரா என்ற அமைப்பு தன்னையும் நுழைத்துக் கொண்டது. முழுப் பூசணிக்காயைச் சோற்றில் மறைக்கும் வகையில் அது வழக்கு தொடுத்தபோது எடுத்த எடுப்பிலேயே அதைத் தள்ளுபடி செய்ய வேண்டிய நீதிபதிகள் அந்த வழக்கை விசாரணைக்கு எடுத்துக் கொண்டதன் மூலம் ஐந்தாவது அநீதியை அரங்கேற்றினர். பாபர் பள்ளிவாசல் என்ற ஒன்று இல்லை; அது ஆரம்பம் முதல் எங்களிடம்தான் உள்ளது. கோவிலாகத்தான் இருந்து வருகிறது. பாபர் இடிக்கவும் இல்லை; மசூதி கட்டப்படவும் இல்லை. அது கோவிலாகத்தான் இருக்கிறது; இதில் முஸ்லிம்கள் இடையூறு செய்யக் கூடாது என்பதுதான் அந்த வழக்கு.
1950  டிசம்பர் 17ல் இந்த வழக்கு தொடரப் பட்டது. உண்மைக்கு மாறான இந்த வழக்கை எடுத்த எடுப்பிலேயே தள்ளுபடி செய்யாமல் இதை நீதிமன்றம் ஏற்றுக் கொண்டு அநீதியை நிலை நாட்டியது. (இந்த அமைப்புக்குத்தான் மூன்றில் ஒரு பங்கு என்று அலகாபாத் உயர் நீதிமன்ற தீர்ப்பளித்துள்ளது என்பது குறிப்பிடத் தக்கது)
முஸ்லிம்கள் தரப்பிலும், வக்ஃபு வாரியத் தின் தரப்பிலும், இந்துக்கள் தரப்பிலும் தாக்கல் செய்யப்பட்ட அனைத்து வழக்குகளையும் அலகாபாத் உயர் நீதிமன்றத்துக்கு மாற்றுமாறு உ.பி. அரசு கேட்டுக் கொண்டதன் அடிப்படை யில் அலஹாபாத் உயர் நீதிமன்றத்துக்கு வழக்கு மாற்றப்பட்டது. கீழமை நீதிபதிகளிடம் இருக்கும் அளவுக்கு மதவெறி மேல் நீதிமன்ற நீதிபதிகளிடம் இருக்காது என்று முஸ்லிம்கள் குருட்டு நம்பிக்கை வைத்திருந்தனர். அதிலும் தோல்விதான்.
நீதிமன்ற அநீதி – 06
ஒரு இடம் யாருக்குச் சொந்தம் என்பதை முடிவு செய்வதற்கு அந்த இடத்தை அகழ்வா ராய்ச்சி செய்யுமாறு சட்டத்தில் கூறப்பட வில்லை. உலகத்தில் எந்த நாட்டிலும் இத்தகைய சட்டம் இல்லை. ஆனால் நீதிபதிகள் சட்ட விரோதமாக அந்த இடத்தை அகழ்வாராய்ச்சி செய்யுமாறு உத்தரவிட்டனர்.
நீதிமன்ற அநீதி – 07
இந்த வழக்கை வக்ஃபு வாரியம் – பாபர் மஸ்ஜித் கமிட்டி, நிர்மோகி அகாரா என்ற அமைப்பு நடத்திக் கொண்டிருக்கிறது. இதில் புதிதாக யாரும் சட்டப்படி உரிமை கோர முடியாது. ஆனால் பார்ப்பன சங்பரிவாரக் கும்பல் உலகமே காரித்துப்பும் வகையிலான கேவலமான செயல் மூலம் மேலும் சிலரை வழக்கில் நுழைத்தது. இதுதான் நடந்த அநியாயத்திலேயே மிகப் பெரியது.
ஒரு சொத்து சம்பந்தமாக வழக்குப் போடுவதாக இருந்தால் அந்தச் சொத்தில் விவகாரம் ஏற்பட்டு 12 ஆண்டுக ளுக்குள் வழக்குப் போட வேண்டும் என்று சட்டம் சொல்கிறது. இந்தச் சட்டத்தில் 18 வயதுக்கு உட்பட்ட மைனர்களுக்கும், மன நிலை பாதிக்கப்பட்டவர்களுக்கும் விலக்கு உண்டு.
ஒரு மைனரின் சொத்தை ஒருவர் அபகரித்துக் கொண்டால் அவர் 12 ஆண்டுகள் கழித்த பின்பும் வழக்குப் போடலாம். இந்தச் சட்டத்தின் அடிப்படையில் இந்தச் சொத்து குழந்தை ராமருக்கு உரியது. குழந்தை ராமர் காலாகாலம் மைனராவார். எனவே ராமர் என்றும் மைனராக உள்ளதால் அவர் எப்போது வேண்டுமானாலும் வழக்குத் தொடரலாம்.
மைனர் நேரடியாக வழக்குத் தொடர முடியாது என்பதால் அவர் சார்பில் அவரது கார்டியன் வழக்குத் தொடரலாம் என்று வாதிட்டு ராமர் பெயரில் வழக்கு தொடரப்பட்டது.
அதாவது எனக்குச் சொந்தமான இடத்தில் பாபர் என்பவர் 450 ஆண்டுகளுக்கு முன் கோவிலைக் கட்டினார். இதற்கு நீதி வழங்க வேண்டும் என்பதுதான் வழக்கு.
ராமர் பிறந்த இடம் மக்களால் வழிபாடு நடத்தப்படுகிறது என்றும் அது மனித அந்தஸ்தை அடைந்து விட்டது என்றும் அந்த மைனரும் வழக்குத் தொடரலாம் என்றும் வாதிட்டு அதன் காப்பாளர் என்ற பெயரில் 1989ல் வழக்குப் போட்டு தங்களையும் வழக் கில் சேர்க்குமாறு கோரிக்கை வைக்கப்பட்டது. தியோகி நந்தன் அகர்வால் என்பவர் அலகாபாத் உயர் நீதிமன்றத்தில் நீதிபதியாக இருந்து ஓய்வு பெற்றவர். இவர்தான் இந்த வழக்கைத் தொடர்ந்தவர். அதாவது மைனரான ராமர் சார்பிலும், மைனரான காவி இடம் சார்பிலும் அதன் பாதுகாவலர் என்ற பெயரில் இவர் வழக்கில் சேர்க்கப்பட்டார்.
உலக மக்கள் இதை அறிந்தால் இந்நீதித்துறையைப் பற்றி என்ன நினைப்பார்கள். காரித்துப்புவார்களே என்ற குறைந்த பட்ச கூச்சம் இன்றி குழந்தை ராமரும், மைனர், காலி மனையும் வழக்கில் சேர்க்கப்பட்ட அதிசயம் நடந்தது.

உலக நீதிமன்ற வரலாற்றில் இதுபோன்று நீதிமன்றங்கள் செயல்பட்டிருக்காது. ஆயினும் உள்ளார்ந்த மத உணர்வின் காரணமாக இவர்களும் வழக்கில் சேர்க்கப்பட்டனர்.
இந்தக் கோமாளித்தனத்தின் அடிப்படையில்தான் மைனர் ராமருக்கு மூன்றில் ஒரு பங்கு என்று தீர்ப்பளித்துள்ளனர் என்பது குறிப்பிடத்தக்கது.
நீதிமன்ற அநீதி – 08
அலகாபாத் உயர் நீதிமன்ற நீதிபதிகள் அடிப்படை இல்லாமலும், உள்நோக்கத்துடனும் அகழ்வாராய்ச்சிக்கு உத்தரவிட்டதன் மூலமும், ராமரை வாதியாக ஆக்கியதன் மூலமும் இப்போதைய தீர்ப்புக்கு அடித்தளம் அமைத்தனர்.
அதன் அடிப்படையில் மைனர் ராமருக்கு மூன்றில் ஒரு பங்கு, நிர்மோகி அகாராவுக்கு மூன்றில் ஒன்று, முஸ்லிம்களுக்கு மூன்றில் ஒன்று எனத் தீர்ப்பளித்து மாபெரும் அநீதியை இழைத்தனர்.
அதாவது இல்லாத ராமரை வழக்கில் சேர்த்து அவரையும் அடுத்தவர் சொத்துக்கு பங்காளியாக்கி விட்டனர்.
பள்ளிவாசலே அங்கே இருக்கவில்லை. பாபர் மசூதியை இடிக்கவும் இல்லை. இது கோவிலாகத்தான் இருக்கிறது என்ற புளுகு மூட்டையை அப்படியே நம்பி அவர்களுக்கு மூன்றில் ஒரு பங்கு, பள்ளிவாசலின் உரிமையாளர்களுக்கு மூன்றில் ஒன்று. இப்படி அநியாயத் தீர்ப்பளித்த அத்தனை பேரையும் ஒட்டு மொத்த முஸ்லிம் சமுதாயமும் தாட்சண்ய மின்றி கண்டிக்கிறது!
நீதிமன்ற அநீதி – 09
அகழ்வாராய்ச்சி அறிக்கையில் கோவில் இடிக்கப்பட்டு பள்ளிவாசல் கட்டப்பட்டதாகக் கூறப்படாத போதும் கோவிலை இடித்து விட்டு பாபர் பள்ளிவாசலைக் கட்டினார் என்ற அவதூறை நீதிமன்றம் கூறியது ஏற்புடைய தில்லை.
நீதிமன்ற அநீதி – 10
அகழ்வாராய்ச்சியில் விலங்குகளின் எலும் புக் கூடுகள் கண்டெடுக்கப்பட்ட பின்பும் அது கோவிலாக இருந்திருக்க முடியாது என்பது இதன் மூலம் நிரூபணமான பின்பும் அது கோவில்தான் என்று கூறியதன் மூலம் பத்தா வாது அநீதி அரங்கேற்றப்பட்டது.
நீதிமன்ற அநீதி – 11
எந்த இடத்தில் பள்ளிவாசலின் மையப்பகுதி இருந்ததோ அந்த இடத்தில்தான் ராமர் பிறந்தார். எனவே அது அவருக்குத்தான் சொந்தமானது என்றும் இந்த நீதிபதிகள் தவறாக தீர்ப்பளித்து விட்டனர். 18 லட்சம் ஆண்டுக்கு முன்னால் ஒருவர் இந்த இடத்தில் பிறந்தார் என்று ஒருவன் கூறினால் அதை சிந்தனையுள்ள எவரும் ஏற்க முடியாது.
நீதிமன்ற அநீதி – 12
பாபர் பள்ளிவாசல் இஸ்லாமியச் சட்டப்படி பள்ளிவாசலே அல்ல என்று கூறிய நீதிபதி நீதி வழங்குவதில் தவறி விட்டார். இப்படி அடுக்கடுக்கான அநீதிகளைத்தான் நீதிபதிகள் பாபர் மஸ்ஜித் வழக்கில் தொடர்ந்து கடைப்பிடித்து வந்துள்ளனர். எனவே இது போன்ற அநீதிகளை அம்பலப்படுத்தி நீதித்துறையை தட்டிக் கேட்கத் தவறினால் நம்முடைய பள்ளிவாசல்கள் ஒவ்வொன்றாகப் பறிக்கப்படும். நீதி வழங்குவதில் தவறிய நீதிபதிகளைத் துணிவுடன் கண்டிக்கவும், உச்ச நீதிமன்றம் இந்த வழக்கை தானாக மறு விசாரணைக்கு உட்படுத்த வலியுறுத்தியும், எந்தப் பள்ளிவாசல் பிரச்சினையையும் நீதி மன்றத்துக்குக் கொண்டு செல்ல பயப்படும் நிலைமை இனியும் நீதிமன்றங்களால் ஏற்படக் கூடாது என்ற நிலையை ஏற்படுத்தவும்,
இருக்கின்ற பள்ளிவாசல்கள் இதுபோன்று நீதித்துறையால் பறிக்கப்படாமல் இருக்க நம் முழு பலத்தையும் திரட்டி கண்டனங்களைப் பதிவு செய்வோம்.
நீதித்துறை சட்டத்தை மீறினால் நீதிமன்றங்களையும் கண்டிக்க தயங்க மாட்டோம் என்பதை உலகறியச் செய்வோம். ஜனவரி 27ல் நம் உணர்வை வெளிப்படுத்துவோம். (TNTJ Plus*)

Ayodhya Verdict, Temple And Indian Nationalism

While Ayodhya verdict is under criticism from various quarters for ignoring the basic issue of land dispute, for ignoring the illegal installation of Ram Lalla idols on the night of 23 Dec 1949 and the demolition of the masjid by Sangh Parivar on 6th December 1992, a new dimension has been added to the issue. In the aftermath of the judgment, RSS Chief Mohan Bhagwat (30th Sept 2010) had welcomed the judgment and stated that this judgment paves the way for grand Ram Temple as court has already allotted 2/3 of land, where the mosque, is located to Hindus. Now (Dec 12, 2010) he goes further to say that division of land is unwarranted and all land should be given to Hindus as division always creates problems as in the case of Kashmir, and that all the land should be handed over to Hidus. According to him this will also be in the fitness of nationalism as it will wipe out Babri Masjid, the symbol of foreign rule. The temple will create the ‘Bharat’s self consciousness’. Giving hint of the future plans, the RSS supremo further said that it is time that we re-establish all such symbols that portend Bharat’s self-image and nature that was razed during the foreign rule.



The statement of Mr. Bhagwat is quiet in tune with the politics, ideology and agenda of RSS. Needless to say the comparison with division of Kashmir is totally warped and illogical. Kashmir was an independent state attacked by Pakistan. Kashmir acceded to India in the face of this aggression and there were clauses of full autonomy of Kashmir barring the matters related to defense, communication, currency and foreign affairs. Indian army entered Kashmir after this accession by which time 1/3 Kashmir was occupied by Pakistan army. It was not a division by any legal authority. The occupation of Kashmir by Pakistan was an act of aggression and United Nations had mandated for plebiscite in Kashmir, which never took place. And Dr. Bhagwat/RSS is worried about the ill effects of division, they can very well leave the ‘manufactured claims’ and restore the masjid pre 6th December 1992 and pre 23 December 1949. That will be an appropriate way to avoid division and solve the issue, releasing us from the vice like grip of identity issues so that nation can focus on infinite ills ailing the country.
In case of Babri masjid it was a protected monument under the Indian act and on the night of 23 December 1949 some motivated elements, hand in glove with sympathizers of Hindu nationalism installed the idols there. Then, RSS elements (Advani and co.) took over the issue in the decade of 1980 and demolished the masjid, which has been one of the biggest crimes in Independent India. It was also an assault on Indian Constitution. The Court gave the verdict in a Panchayat style ignoring the core elements of the case, also under the dominating influence of communalization of society which has been unleashed by the communal violence and propaganda. What is needed is to look at the clauses of Indian Constitution and restore the land to the Sunni Wakf Board, under whose possession that land has been for long enough time to be legally valid.
To regard the structures built during medieval period as symbols of foreign rule is contrary to the concept of Indian Nationalism. Indian Nationalism regarded British rule as foreign rule and struggled against it. Still it did not talk of wiping out the structures built by British during their rule. RSS type ideologies never struggled against the foreign rule, British rule, and regard the period of Muslim Kings as the period of foreign rule. This again goes against the understanding of Indian nationalism. Kingdoms are Kingdoms and we can’t equate Kingdoms to nationalism. Kings of different religions have ruled for power and wealth. They were neither representative of the people nor of their religion. Since RSS ideology emerged form the declining social sectors of Hindu Kings, Landlords and clergy they have deliberately accorded to Kings’ rule the status of nationalism. Same applies to the Muslim communal ideology that accords the status of nationalism to the rule of Muslim Kings. There is a deliberate confusion between the concept of Kingdoms and Modern nation states in communal ideology. Communal ideologies imagine that all religious communities were homogenous and fighting against other religious communities.
Hindu Kings were exploiting Hindu peasants and Muslim kings were not targeting Hindu peasants just because they were Hindus. Barring few exceptions religion was not the goal of kings Also it is interesting that except initial plundering by some Muslim Kings, once they settled here in collaboration and alliance with Hindu Kings, they did not take away the wealth of this land to other places. On contrary British rule was primarily for plunder of resources of the country. The RSS, communal ideologies’ ignoring the British exploitation and harping on Muslim Kings is due to their agenda of religious nationalism, which is away from the values of freedom movement; Liberty, Equality and Fraternity. In Modern nationalism, Indian Nationalism, the past is not looked through religious angle and the main goal is to build the future on the principals enshrined in Indian Constitution. That’s how Pundit Jawaharlal Nehru emphasized on ‘new temple’ of Modern India; Educational institutes and industries. Contrary to this for RSS the temples of past when Hindu Kings ruled and applied the laws of Manu, birth based hierarchy of caste and gender, is their political and social agenda.
British deliberately gave a communal twist to the History by projecting Kings as Hindus or Muslims and sowed the seeds of division between the people. Muslim League on one side and Hindu Mahsabha-RSS on the other played a compliant role to British Policy, accepted their version of History, and spread hatred against the other community. This ‘Hate other’ laid the foundation of communal violence and Partition of India, which was the highest index of success of British policy of divide and rule, in which communalists came in handy to execute the British designs of splitting the communities along religious lines. Muslim League-RSS were ideal puppets in the hands of British. Today in India the divisive politics is again being deliberately promoted to sidetrack the core issues related to bread, butter, employment and shelter, to undermine the concept of rights and dignity of average people.
RSS Chief’s call to reestablish all such symbols is fraught with danger. Where will one stop? With rule of Hindu Kings?; some may like to go further back to the demolition of Buddha Vihars by Hindu rulers? And then what will one do with the Aryans coming to India and their dominating the native Adivasi and others? The whole country did accept 15th August as the starting point of our nation, and made it a point of departure from the past to initiate the future building of peace and progress. The ideologies and calls being given by RSS family are something alien to Indian nationalism and they need to be combated against to preserve and protect the very idea of India as it emerged during national movement and as it was nurtured by the founding fathers of India.
Ayodyah judgment also needs a relook form the same barometer of Indian legality and not RSS agenda of dividing people along religious lines. It is needed that all those committed to the values of amity of communities, and Indian Constitution, all those valuing the concept of Human rights come forward and spread the awareness about the Indian nationalism and build the bridges amongst religious communities to focus on progress of the nation in the field of education and industrialization on the basis of Human rights of all Indians, leaving the mosques and temples in peace, as they are; where they are. Sri Lanka’s Muslims facing leadership vacuum

With the bloody demise of the LTTE the Muslim community in Sri Lanka has reached political crossroads.



In fact, even when the LTTE was at its summit of military might and political clout the Muslim community confronted two crucial questions: One, what would be the fate of the community in the unlikely event of a divided Sri Lanka between a Tamil Eelam, which would include one third of the Muslims, and a Sinhala Lanka with the rest two-thirds? And two, what would be the fate of the community's so called 'politics of pragmatism' once the LTTE was wiped out?

The fact that there was no serious public discussion or debate on these questions between 1983, when the LTTE took to its armed struggle, and 2009, when it was militarily eliminated, demonstrates not only a lack of foresight within the Muslim political leadership but also the community's lackadaisical attitude towards national issues little realising that the price of insouciance could be very costly to the community's long term survival and welfare.

Muslim political leadership in independent Sri Lanka always revolved around personalities and not around programmes or policies. Even the political structures created by some leaders, such as the All Ceylon Moors Association of Razik Fareed, Ceylon Muslim League of M. C. M. Kaleel, the Islamic Socialist Front of Badiuddin Mahmud, the Anti-Marxist Front of M. H. Mohamed, and the Sri Lanka Muslim Congress of M. H. M. Ashraff, operated chiefly to promote the popularity of the founders and increase the chances, for them and their followers, of winning a particular political contest in the short run rather than to sustain those structures with a plan of action and programmes to benefit the interest of the community and nation in the long run.

This was why when epochal issues like Ceylon citizenship, official-language, socialist-reforms, constitutional changes, and ethnic nationalisms were debated in the national legislature the contribution to those debates from Muslim parliamentarians, with very rare exceptions, lacked intellectual depth and national vision.

There are two main reasons for this shortcoming, one arising from political expediency and the other from religious orthodoxy. Being the third largest ethno-religious group in a multi-ethnic Sri Lanka, political expediency dictated that it would always be in the best interest of the middle community to side with the winning majority, even if that majority's programmes and policies were to prove, in the long run, detrimental to national unity and economic prosperity.

Muslim politicians followed this dictate to its extreme limits since the 1950s and as one of them said pithily "divided they are (meaning the Sinhalese and the Tamils) we swim and united they are we sink". This myopic and businesslike approach to national politics made many Muslim politicians to remain indifferent at best and unpatriotic at worst when confronted with issues of national and international importance such as citizenship, official language, constitutional reforms, higher education and Islamism.

Islamic orthodoxy, especially its fundamentalist variation, is excessively otherworldly in its outlook. The belief in the transient nature of earthly life and the certainty and fear of the Hereafter creates a feeling of detachment and indifference toward mundane matters unless such matters help the preparation of this life to success in the Hereafter. The psychological impact of this belief at the national political level is for Muslims to accept the fact that Sri Lanka is not a Muslim country and that therefore it does not matter who rules the country as longs as Muslim interests are protected and promoted. Irrespective of the variety of stratagem that different Muslim leaders chose to maintain their leadership the objective always remained parochial and communal.

Since late 1940s Muslim politics in Sri Lanka followed the leadership of three personalities: Sir Razik Fareed (1893-1984), Dr. Badiuddin Mahmud (1904-1997), and M. H. M. Ashraf (1948-2000). Razik Fareed's political strategy, sometimes described as politics of pragmatism, was always to join the winning party, be a part of the government and work for the community. Party ideology, principles and policies hardly mattered to him. Badi's strategy was to commit firmly to the policy and principles of one particular political party and work for the community from within.

Accordingly, he became one of the founder members of the Sri Lanka Freedom Party and remained in it until his death. He entered the parliament unelected and was appointed as the Minister of Education. It is not unfair to say that his ministry, during his tenure of office, virtually became the employment exchange for Muslims. Ashraf's strategy was to form a separate political party for the Muslims, gain as many seats as possible in a general election and use that strength as bargaining chip to win favours to the community from ruling governments.

Although the Muslim community made significant strides in the field of education, public sector employment, religious and cultural welfare and so forth during the leadership of each of the three personalities, it was more the widening political gulf between the two main communities of the island, the Sinhalese and the Tamils, rather than the particular political strategies of Muslim leaders that was responsible to their community's achievements. None of the leaders had a long term national vision or programme that could win the admiration and support of the other communities in the island.

Being a community caught in the middle in the growing animosity between the Sinhalese and the Tamils, Muslims had certain demographic, linguistic, and religious factors that could have strengthened the role of their leaders, had they wanted, as bridge builders in the communal conflict. Demographically, Muslim settlements are spread over the entire nine provinces of the nation and any proposed division of the country on communal lines would be detrimental to Muslims caught in the division.

Linguistically, although the vast majority of them speak Tamil as their mother tongue, many of them, unlike the members of the other two communities, have conversational fluency in Sinhalese also. Religiously, the concept of brotherhood in Islam and Allah's command in the Quran that humankind was created from a single pair of a male and female and made into different tribes so that they may know and not despise each other lays a solid foundation for Muslim leaders to work for communal tolerance and national unity. Unfortunately, none of these factors were exploited by the Muslim leaders to act as spokespersons for the unity of the nation. What was lacking in them was long term national political vision and commitment to the nation.

Throughout the history of independent Sri Lanka the Muslim community never made any attempt to create a think-tank of intellectuals to advise and guide political leaders. Muslim politicians always sidelined the intellectuals in the community although the number of such intellectuals was not many at any time. Sidelined by the politicians and ignored by the rich and powerful a few of them left the country while the ones who remained in the country rarely spoke out on public issues affecting the community and the nation. The growing environment of political violence since the late 1970s made even that rarity totally non-existent.

After the untimely demise of Ashraf, Muslim political leadership in Sri Lanka has become vacuous and acephalous. There are now more Muslim politicians and ministers than ever in the history of the community but none of them has shown so far the philosophical and intellectual depth and vision necessary to lead a community at the national level.

The way they led the community along a blind alley in the last presidential elections amplifies this deficiency. There is a need for a statesman-like Muslim leadership and the time has come to the Muslim intellectual community to lead this search. In terms of Islamic shariah it is not only their individual religious duty (fard-al-ayn) but also a duty imposed upon their community (fard-al-kifaya) .

இலங்கை முஸ்லிம்களின் தலைமையின்மை

இலங்கையில் புலிகளின் வீழ்ச்சிக்குப் பிறகு இலங்கை முஸ்லிம்கள் எம்மாதி ரியான அரசியல் வழியைப் பின்பற்று வது என்று தெரியாமல் விழி பிதுங்கி நிற்கிறார்கள்.


புலிகள் இராணுவ வலிமையுடன் உச்சகட்டத்தில் இருந்த போதுஇலங்கை முஸ்லிம் சமூகத்தின் முன் இரண்டு முக்கிய கேள்விகள் எழுந்தன. ஒன்றுஒருகால் புலிகளின் கோரிக்கை ஏற்கப்பட்டு இலங்கை இரண்டாகப் பிரிய நேரிட்டுஅதில் மூன்றில் ஒரு பகுதி தமிழ் ஈழமாகவும்மிகுதி மூன்றில் இரு பகுதி சிங்கள சிறிலங்காவாகவும் பிரிக் கப்பட்டு அதில் தமிழ் ஈழப் பகுதிக் குள் முஸ்லிம்களும் சேர்க்கப்படுவார்களானால் அப்போது முஸ்லிம்களின் எதிர்காலம் என்னவாகும்அல்லது புலிகள் முற்றாக அழிக்கப்பட்டால் அப் போது இலங்கையில் முஸ்லிம்களின் எதிர்கால அரசியல் சாத்தியக் கூறு கள் எப்படியிருக்கும்?
1983ல் ஈழப் போர் துவங்கிய நாளிலிருந்து 2009ல் புலிகள் முற்றாக அழிக் கப்பட்ட இடைக்காலத்தில் முஸ்லிம்களிடையே இது பற்றிய வெளிப்படை யான விவாதங்களோ சிந்தனையோ இருக்கவில்லை. முஸ்லிம் தலைவர் களிடமும் எவ்வித தூர நோக்குப் பார்வையும் இருக்கவில்லை. தவிரமுஸ் லிம்களைப் பாதிக்கக் கூடிய தேசியப் பிரச்சினைகள் எது பற்றியும் எந்த முடிவும் எடுக்க தயக்கம் காட்டும் பழமைவாத நிலைப்பாடு ஆகியவை முஸ்லிம் சமுதாயத்தைப் பிற்காலத்தில் எந்தளவு பாதிக்கும் என்பதைக்கூட அவர்கள் உணரவில்லை. அது அவர்களின் எதிர்கால வாழ்க்கைப் பிரச்சினை என்பதையும் அவர்கள் புரிந்து கொள்ளவில்லை.
சுதந்திர இலங்கையில் முஸ்லிம் தலைமைத்துவம் எப்போதும் தனி மனிதர்க ளையே சார்ந் திருந்தது. கொள்கைகள்திட்டங்கள் அடிப்படையில் அமைய வில்லை. சில அரசியல் அமைப்பு கள் உருவானாலும் உதாரணமாகAll Ceylon Moors Association சேர்.ராஸிக் பரீத் தலைமையிலும்சிலோன் முஸ்லிம் லீக் எம்.ஸீ.எம். கலீல் தலைமையிலும்இஸ்லாமிக் சோஷலிஸ்ட் முன்னணி பதி யுத்தீன் மஹ்மூத் தலைமையிலும்,மார்க்ஸிஸ்ட் எதிர் முன்னணி எம்.எச். முஹம்மத் தலைமையிலும்சிறிலங்கா முஸ்லிம் காங்கிரஸ் எம்.எச்.எம்அஷ்ரப் தலைமையிலும் அமைந்தன.
ஆனால்அவர்கள் தங்களை முன்னிலைப்படுத்துவதிலும் தேர்தல்களில் தாங் களும் தம்மைப் பின்பற்றுவோரும் வெற்றி பெறவும்தான் எண்ணினார்களே தவிரதங்கள் சமுதாயம் நீண்ட காலம் பயனடையக் கூடிய திட்டங்களை மேற்கொள்ளவில்லை. எந்தக் கட்சி ஆட்சிக்கு வந்தாலும் அதனை ஆதரித்து தங்கள் சமூகத்திற்குத் தேவையானவைகளை நிறைவேற்றிக் கொண்டால் போதும் என்று எண்ணினர்.
அதனால்தான் முக்கியமான காலத்தின் கட்டாயப் பிரச்சினைகளான இலங்கை குடியுரிமைஆட்சி மொழி,சோஷலிச சீர்திருத்தம்அரசியல் சட்டத் திருத்தங்கள்இன தேசியவாதம் போன்றவை விவாதத்திற்கு எடுத்துக் கொள் ளப்பட்டபோது ஒரு சிலரைத் தவிர முஸ்லிம் பார்லிமெண்ட் உறுப்பினர்கள் தேசிய பார்வையுடன் கூடிய ஆழமான கருத்துகளை சபைமுன் வைக்க வில்லை.
இந்தக் குறைபாட்டிற்கு இரண்டு காரணங்களைக் கூறலாம்ஒன்றுஅரசியல் சந்தர்ப்பவாதம். இரண்டுசமய அடிப்படையிலான பழைய நம்பிக்கைகள். இலங்கையின் பல்லின சமுதாயத்தில் மூன்றாவது பெரிய இனவழி சமயப் பிரிவாக இருந்துகொண்டு தங்கள் சமுதாயத்திற்குத் தேவை யானவற்றை கேட்டுப் பெறுவதைவிட்டு,அரசியல் சந்தர்ப்பவாதத்தை மேற்கொண்டு வெற்றி பெற்ற பெரும்பான்மை கட்சியின் ஆட்சியை ஆதரித்ததன் மூலம் தேசிய ஒற்றுமைக்கோ பொருளாதார வளத்திற்கோ உதவவில்லை.
இந்தக் கொள்கையை 1950 லிருந்து முஸ்லிம் அரசியல்வாதிகள் பின்பற் றினர். ஒருவர் கூறினார்: சிங்களவர்களும்தமிழர்களும் பிரிந்து நின்றால் சந் தர்ப்பத்திற்கேற்ப முஸ்லிம்கள் அதில் நீச்சலடிக்க முடியும். அவர்கள் இணைந்தால் முஸ்லிம்கள் மூழ்கிப் போய்விட நேரிடும்.
சுயநலமிக்க வர்த்தக ரீதியான மனப்பான்மையினால் தேசிய அரசியலில் அவர்களின் அணுகு முறை சரியானதாக இல்லை. முஸ்லிம் அரசியல்வாதி களின் மாறுபாடான மனப்பான்மையினால் தேசபக்தியற்றவர்களாகக் காணப் பட்டனர். முக்கியமாககுடியுரிரமைஆட்சி மொழிஅரசியல் சட்டத்திருத்தம்,உயர் கல்வி மற்றும் இஸ்லாம் போன்ற முக்கிய பிரச்சினைகளைப் பற்றி அவர்கள் கவலைப்படவே இல்லை.
இஸ்லாமியப் பழமைவாதம் முக்கியமாக அடிப்படைவாதம் இம்மையை விட மறுமையைப் பற்றி அதிகம் முக்கியத்துவம் கொடுக்கிறது. இம்மையில் செய் யக் கூடிய செயல்கள் மறுமைக்கு உதவுவதாக இருக்க வேண்டும் என்று எதிர்பார்த்தனர். இந்த நம்பிக்கை தேசிய அரசியல் மட் டத்தில் முஸ்லிம்கள்இலங்கை ஒரு முஸ்லிம் நாடு அல்ல என்பதால் அவர்களுக்கு நாட்டை யார் ஆண்டால் என்ன என்ற மனப்பான்மையும் முஸ்லிம்களின் உரிமைகள் பாது காக்கப்பட்டால் போதும் என்ற எண்ணமும் மேலோங்கி நின்றது.
இப்படி மாறுபட்ட கருத்துக் களைக் கொண்டவர்களிடையேயும் இனவாத அடிப்படையில் குறுகிய எண்ணங்களைக் கொண்டவர்களிடையேயும் தங்கள் தலைமையை முஸ்லிம் தலைவர்கள் நிலைநிறுத்தினார்கள்.
1940லிருந்து இலங்கை முஸ்லிம் அரசியல் மூன்று தலைவர்களின் பின் இருந்தது.
1.             சேர். ராஸிக் பரீத் (1904-1997)
2.             டாக்டர் பதியுத்தீன் மஹ்மூத் (1904-1997)
3.             எம்.எச்.எம். அஷ்ரப் (1948-2000)
சேர். ராஸிக் பரீதின் அரசியல் சில நேரங்களில் அரசியல் வியூகம் என்று பார்க்கப்பட்டது. அவர் எப்போதுமே வெற்றி பெற்ற கட்சியுடனே இருப்பார். அரசியல் பங்கு வகிப்பார். அதன் மூலம்தன் முஸ்லிம் சமுதாயத்திற்கு சேவை செய்தார். கட்சிக் கொள்கை நடைமுறை இவைகளைப் பற்றி அவர் கவலைப் படுவதில்லை. தன் சமுதாயத்திற்கு என்ன வேண்டுமோ அதைப் பெற்றுக்கொடுத்தார்.
டாக்டர் பதியுத்தீனோஓர் அரசியல் கட்சியின் கொள்கைகளுக்குக் கட்டுப்பட்டு அதில் தன்னை முழுமையாக ஈடுபடுத்திக் கொண்டு அக்கட்சியிலிருந்தவாறே தனது சமுதாயத்திற்குத் தேவையானவைகளைப் பெற்றுத் தந்தார்.
அதன் அடிப்படையில்அவர் இலங்கை சுதந்திரக் கட்சியைத் துவங்கிய உறுப்பினர்களில் ஒரு வராகத் திகழ்ந்தார். அவர் இறக்கும்வரை அதே கட்சி யிலேயே தொடர்ந்து அங்கம் வகித்தார். அவர் பாராளுமன்றத்திற்குத் தேர்ந் தெடுக்கப்படாமலே உறுப்பினரானார். தொடர்ந்து கல்வி அமைச்சரும் ஆனார். அவர் காலத்தில் அவருடைய கல்வி அமைச்சு முஸ்லிம்களுக்கு வேலை வாய்ப்பை உருவாக்கித் தரும் அமைப்பாக மாறியது என்று கூறினால் மிகையாகாது.
அஷ்ரபின் அரசியல் திட்டம்இலங்கை முஸ்லிம்களுக்கென்றே தனியாக ஒரு அரசியல் கட்சியை தோற்றுவித்துஅதிக அளவில் பார்லிமெண்டில் இடங் களைக் கைப்பற்றுவது. அதனைக் கொண்டு முஸ்லிம்களின் பிரச்சினைக ளுக்கும் தேவைகளுக்கும் ஆட்சியாளர்களிடம் பேரம் பேசி பெற்றுத் தருவது.
மூன்று தலைவர்களின் காலத்தில் முஸ்லிம்கள் கல்விபொதுத் துறை வேலை வாய்ப்புசமய கலாசார நலன் ஆகியவைகளில் பெரும் வளர்ச்சி யைக் கண்டாலும் இரண்டு பெரும் இனங்களிடையே -சிங்களவர்கள்தமிழர் கள்- ஏற்பட்ட பிளவுதான் இவர்களுக்கு இந்த வாய்ப்பைக் கிடைக்கச் செய்தது. மூன்று தலைவர்களிடமும் தங்கள் சமூகத்தின் எதிர்காலத்திற்கான திட்டமோ தேசியப் பார்வையோ இல்லாததால் மற்ற இனங்களிடமிருந்து போதுமான ஆதரவு முஸ்லிம்களுக்குக் கிடைக்கவில்லை.
சிங்கள இனத்திற்கும் தமிழர் களுக்கும் இடையே பகையுணர்வு அதிகரித்து வந்தது. முஸ்லிம்கள் தங்கள் சனத்தொகைமொழிநாடுசமயம் இவற்றைக் கொண்டு தங்கள் தலைவர்களைப் பலப் படுத்திபோரிடும் இரு இனங் களுக்கிடையே நல்லுறவு ஏற்பட ஒரு பாலமாக இருந்திருக்க முடியும். மக் கள் தொகைக் கணக்குப்படி முஸ்லிம்கள் எல்லா மாகாணங்களிலும் பரந்து வாழ்ந்து வந்தனர். இந்நிலையில் இனவாரியாக நாட்டைப் பிரித்தால் அதி கம் பாதிக்கப் போவது முஸ்லிம் கள்தான்.
மொழிவாரியாகப் பார்த்தால் முஸ்லிம்கள் அனைவரும் பேசுவது தமிழ்தான். மற்ற இனத்தைப் போல் அல்லாமல் முஸ்லிம்கள் சிங்கள மொழியில் பேசவும் எழு தவும் திறன் பெற்றிருந்தார்கள்.
திருக்குர்ஆனில் இறைவன்மனித குலம் ஒரு ஆண் ஒரு பெண்ணிலிருந்து உருவாகியது என்றும் அந்த இருவரிடமிருந்து தான் உலகில் பல இன மக்கள் உருவாகினர் என்றும் கூறுகிறான். அதனால் மற்றவர்களை வெறுக் கக் கூடாது என்பது அடிப்படை. முஸ்லிம் தலைவர்கள் திருக்குர் ஆன் வழியில் தேசிய ஒருமைப் பாட்டிற்கும் சமூக நல்லிணக்கத்திற்கும் சேவை செய்திருக் கலாம். இம்மாதிரியான செயல்களைத் துரதிர்ஷ்டவசமாக முஸ்லிம் தலை வர்கள் எண்ணிப் பார்க்கவில்லை. நாட்டின் ஒருமைப் பாட்டிற்கே முஸ்லிம் கள்தான் காரணம் என்ற நல்ல பெயரைப் பெறத் தவறிவிட்டனர். நீண்ட காலத்திற்கான அரசியல் பார்வையும் தேசத்தின் மீது தங்கள் விசு வாசமும் அங்கு காணப்பட வில்லை.
அரசியல் தலைவர்களுக்கு ஆலோசனை கூறி வழிகாட்ட அறிஞர்களைக் கொண்ட குழுவை இலங்கை வரலாற்றிலேயே முஸ்லிம்கள் அமைத்துக் கொள்ள வில்லை. மாறாகமுஸ்லிம் தலைவர்கள் அறிஞர்களை ஓரம் கட்டியே தங்கள் அரசியலை நடத்தினர். செல்வந்தர்களும் அறிவுசார்ந்த பெருமக்களை உதாசீனப்படுத்தினர். அதனால் பல நுண்ணறிவாளர்கள் வெளி நாடுகளுக்குச் சென்று குடியேறி விட்டனர். நாட்டை விட்டுச் செல்லாத ஒரு சில அறிஞர்களும் சமுதாயத்தையும் நாட்டையும் பாதிக்கும் பிரச்சினைகளில் தங்கள் கருத்துக்களைச் சொல்வதில்லை.
1970க்குப் பிறகு துவங்கிய அரசியல் வன்முறை தலைதூக்க ஆரம்பித்ததும் அந்த அறிவுசால் பெருமக்கள் தங்கள் வாயையே திறப்பதில்லை. துரதிர்ஷ்ட மாக அஷ்ரப் மறைந்தவுடன் முஸ்லிம் அரசியல் உலகம் தலைமையின்றி வெற்றிடமாக மாறியது. இப்போது வரலாற்றில் இல்லாத அளவு மிக அதிக அளவில் முஸ்லிம் அரசியல் வாதிகளும் அமைச்சர்களும் இருக்கிறார்கள். அவர்கள் தலைமைப் போட்டியால் பல கட்சிகளாகப் பிரிந்து நிற்கிறார்கள். ஆனால்இவர்கள் யாருக்கும் தங்கள் சமுதாயத்தை தேசிய அளவில் கொண்டு செல்லும் அளவுக்கு அறிவும் ஆற்றலும் முன்னோக்குப் பார்வையும் இல்லை.
அவர்கள் தங்கள் சமுதாயத்தை இருள் சூழ்ந்த கண்ணுக்குத் தெரியாத பாதையில் அழைத்துச் செல்கிறார்கள். நிர்வாகத் திறன் கொண்ட ஒரு தலைமை உருவாவது இப்போதைய காலத்தின் கட்டாயம். இஸ்லாமிய ஷரீஅத் சட்டப்படி இது  தனிப்பட்ட ஒருவரின் சமயக் கடமை மட்டுமல்லஒட்டுமொத்த சமுதாயத்தின் மீதும் கட்டாயக் கடமையாகும் (Meelparvai Plus*)

புலி ஆதரவு அமைப்புகள் அடாவடித்தனம் எம்பி பைசல் காசிம் விரட்டப்பட்டார் !


‘’புலி (LTTE-Tamil Zionists) ஆதரவு அமைப்புகளின் அடாவடித்தனம்’’ 
இன்று கோவையில் ஜவுளி வர்த்தகக் கண்காட்சியை திறந்து வைக்க வந்த இலங்கை  எம்பி  பைசல் காசிம் இன்று மதிமுக மற்றும் பெரியார் திராவிடர் கழகத்தினர் உள்ளிட்ட தமிழ் உணர்வாளர்களால் விரட்டியடிக்கப்பட்டனர் என்று இந்திய செய்திகள் தெரிவிக்கின்றன

கண்காட்சியை திறந்து வைக்காமலேயே பின்வாசல் வழியாக  ஓட்டம் பிடித்தனர். இதில் பங்கேற்க சிறப்பு அழைப்பாளர்களாக இலங்கையைச் சேர்ந்த எம்.பி.  பைசல்காசிம், அமைச்சர் ரிஷாத்  ஆகியோர் அழைக்கப்பட்டிருந்தனர். இவர்கள்தான் கண்காட்சியை திறந்து வைப்பதாகவும் இருந்தனர் ஆனால் அமைச்சர் ரிஷாத் இந்தியா செல்லவில்லை விரிவாக பார்க்க video
என்றும் அந்த செய்தி தெரிவிக்கின்றது இந்திய புலி பயங்கரவாத ஆதரவு அமைப்புகளால் இந்த வெளியேற்றம் இடம்பெற்றுள்ளதாக அறிய முடிந்தாலும்
அமைச்சர் ரிஷாத் இந்தியா செல்லவில்லை இலங்கையில்தான் இருக்கின்றார் என்பது உறுதிப்படுத்தப்பட்டுள்ளது பாராளுமன்ற உறுப்பினர் தற்போது இலங்கையில் இல்லை என்றும் முஸ்லிம் காங்கிரஸ் கட்சிக்கு அறிவிக்காமல் இந்தியா சென்றுள்ளார் என்றும் அறிவிக்கபட்டுள்ளது (Lanka Muslim)
